The UK Home Office is preparing to overhaul the requirements for obtaining Indefinite Leave to Remain (ILR). Under the proposed framework, settlement timelines for work visa holders, low-paid sectors, health and care workers, refugees and entrepreneurs would change significantly.
If implemented, the new system would increase ILR waiting periods to 10–20 years for certain categories, while reducing the timeframe to 3–5 years for highly skilled or high-income applicants. The proposal also strengthens integration requirements such as higher English language levels, voluntary community work, clean criminal records and overall contribution to British society.
The reform has not yet been enacted. A public consultation is open until 12 February 2026. However, if approved, all applicants who have not yet secured ILR will fall under the new rules.

Income will also play a key role in determining settlement eligibility:
Applicants who have earned £50,000 in each of the last three years may qualify for ILR in 5 years.
Those earning £125,000+ may qualify in 3 years.
This proposal marks the start of a new “contribution-based settlement” approach. However, current rules remain in force—meaning the planning you do today may significantly shorten your future path to permanent residence.
