Housing disrepair claims exempt from the Fixed Recoverable Costs (FRC) regime until 2028
The Ministry of Justice (MoJ) has officially confirmed that housing disrepair claims will be exempt from the new Fixed Recoverable Costs (FRC) regime, which comes into effect on 1 October 2025, for a period of three years.
This means that tenants suffering from damp, subsidence, safety hazards or health risks in their homes will not face capped legal fees when taking action.
For many renters who have previously hesitated to pursue legal claims due to cost risks, this exception restores access to justice.
