Legal professionals are warning personal injury claimants to be aware of new cost recovery risks under the reformed Qualified One-Way Costs Shifting (QOCS) regime.

While QOCS was originally intended to protect claimants from paying defendants’ legal fees if they lose, changes implemented in April 2023 now allow defendants to recover their legal costs from a claimant’s compensation in some cases. This includes instances where a claim is ruled to be fraudulent, fundamentally dishonest, or abusive.
