The UK family justice system and child custody proceedings have once again become the centre of intense public debate. Recent reports published by ITV News, The Guardian, and discussions held in the UK Parliament have increased criticism that victims of domestic abuse are not being adequately protected within the family court system.

In a special ITV News report, a mother who described herself as a survivor of domestic abuse claimed that her former partner had used ongoing child custody proceedings as “a tool of control and coercion.” She stated that the years-long legal battle caused severe emotional and financial harm, adding that her family was forced to sell their home to cover mounting legal costs.

During last week’s parliamentary session titled “Family Justice System: Domestic Abuse and Safeguarding”, MPs argued that domestic abuse allegations are often not given sufficient weight within family court proceedings. Discussions highlighted concerns that many courts fail to treat allegations of abuse as an active safeguarding risk in child arrangement cases.

A research report published by the House of Commons Library found that allegations of domestic abuse are present in approximately 60% to 90% of child arrangement cases across England and Wales. The report stressed the need for further reforms focused on child safety and safeguarding.

Following increasing criticism, the UK government is now preparing major reforms to the family court system. Under the proposed Courts and Tribunals Bill announced in March, the government plans to remove the legal principle known as the “presumption of parental involvement.” Officials stated that the reforms are intended to place greater emphasis on protecting children from harm.

Family law specialists emphasise that these cases involve highly sensitive issues extending far beyond custody arrangements, including child welfare, psychological wellbeing, financial support, parental contact rights, and domestic abuse allegations.
