Tarihi Birleşik Krallık Mahkeme Kararı: Eşin Payı “Kontrolcü Davranış” Nedeniyle Azaltıldı

A significant financial remedies ruling in UK family law has highlighted how “coercive control” and controlling behaviour may now play a much greater role in divorce-related financial settlements. The case has attracted widespread attention among family law specialists and could influence future disputes involving psychological and economic abuse.
According to reports published by The Times and family law publications, the English Family Court substantially reduced one spouse’s share in a divorce settlement worth approximately £22 million. The court concluded that the wife had engaged in manipulative and controlling behaviour towards her partner throughout the marriage.
The couple, identified only as “LP” and “MP”, were said to have experienced years of psychological pressure, false accusations, and financial manipulation during their marriage. The judge described the conduct as “deplorable behaviour.”
Under normal circumstances, UK family law generally treats equal division of marital assets as the starting principle. However, in this case, the court ruled that coercive and controlling behaviour could directly impact financial distribution between spouses.
As a result, the judge reduced the wife’s share of the marital assets by approximately 40%. The ruling has reignited long-standing legal debate about the extent to which personal conduct should influence financial remedies decisions in divorce proceedings.
Family law experts say the judgment could become an important precedent, particularly in cases involving domestic abuse, coercive control, and economic manipulation. According to specialists, UK courts are increasingly prepared to consider not only physical violence, but also psychological pressure and financial abuse during financial remedy proceedings.
Reports also suggest that financial disputes following divorce have increased significantly in recent years across the UK. Rising living costs, increasing property values, and more complex financial arrangements are believed to be contributing factors.
Legal experts continue to stress that full financial disclosure is essential in financial remedies proceedings and warn that parties who attempt to conceal income or assets may face serious legal consequences.
